IRAA Course Terms & Conditions

These terms and conditions apply to those who purchase International Rugby Academy of Australia products and services.

  1. Definitions
    • “Agreement”: refers to the contract you have entered into by purchasing the products and/or services to which these terms and conditions apply.
    • “Course materials”: material provided to the individual participants for the purpose of International Rugby Academy of Australia services
    • “Customer”: an individual, group or other commercial enterprise to which International Rugby Academy of Australia services are being provided
    • “Quote”: Refers to the price quoted in a proposal document, contract or any other form of formal communication
    • “Set courses”: Refers to our range of set courses open for registrations e.g. High Performance Coaches Course, Advanced Players Course etc.
  2. General
    • These terms and conditions should be read and accepted by the customer prior to purchase. You accept by purchasing any of our products or services, you agree to be bound by these terms and conditions.
    • The International Rugby Academy of Australia reserves the right to modify these terms and conditions and vary any course personnel from time to time.
    • The agreement shall be governed by Australian law. Any dispute under the agreement shall be submitted to the exclusive jurisdiction of Australian courts.
    • Except as set out in these terms and conditions, any variations, including the introduction of any additional terms and conditions, shall only be binding when agreed in writing and signed by both parties.
    • The International Rugby Academy of Australia shall provide the services requested, and as described in any formal written proposal, exercising reasonable skill and care at all times.
    • The International Rugby Academy of Australia reserves the right to
      1. refuse or restrict admission to any given course; or
      2. adjust dates, postpone, or cancel any given Courses under appropriate circumstances; or
      3. change the course venue to any given location.

Wherever the International Rugby Academy of Australia exercise the above clauses, as much notice as possible will be given to the customer.

3.  Warranties

3.1.  The International Rugby Academy of Australia warrants to provide the services with all care and skill to be executed by a competent education provider.

  • If the services requested are not performed, the International Rugby Academy of Australia will make good the performance, re-perform the service or refund the customer at its option.
  • The obligations in clause 3.1 will not apply where: the defective of the service concerned was based upon information supplied or varied from the normal service at the specific request of the customer; or the customer failed to notify the International Rugby Academy of Australia of the defect within 14 days of the supply of service.

4. Customer obligations

  • The International Rugby Academy of Australia is not responsible for the security of personal belongings and the customer obliges to accept full responsibility for these upon entering this agreement.
  • The customer will at all times listen to and respect the instructions, orders and guidance that is provided by the course facilitator.
  • The customer agrees that the International Rugby Academy of Australia can use photo and video content of the participant on their Set Course in publications, promotional material and/or the International Rugby Academy website.
  • The International Rugby Academy of Australia reserves the right to cancel any agreed service, or, ask a customer to leave if the customer is not deemed to be meeting the appropriate action as outlined in clause 4.2, or
  •  The course facilitator feels you are being disruptive in any way,
  • The course facilitator feels you are spoiling the enjoyment of other customers; or
  • You are recording or filming the event or part thereof where you have been asked not to.

5. Fees, payment, refunds and cancellation/deferment

  • For our range of set courses, full payment of course fees is due on or before two weeks prior to the day of course commencement.
  • If payment is not received prior to the Course Start Date, a 10% administration fee may be charged at the International Rugby Academy of Australia’s discretion.
  • All refund requests must be received in writing. Refunds will be provided where payment has been made and a request for a refund has been received three months (or more) prior to Course Commencement date. Any refund requests made within three months of the Course Commencement date will be liable to the cancellation policy below.
  • Any prices quoted to the Customer for the provision of courses will be based on prevailing price lists in force at that time. 
  • Prices quoted to the Customer on a bespoke basis (otherwise referred to as customised courses) are only valid from 30 days from the date of any written quote unless otherwise specified.
  • All fees quoted are for the provision of services only and exclude any travel, extra accommodation or other expenses that may be required for course attendance, outside of what is specified (unless otherwise listed).
  • All cancellation requests must be received in writing.
  • In the event the participant wants to cancel their application/registration, the following cancellation fees will apply:
    • Cancellation requests received more than three months prior to the course will not incur a charge.
    • Cancellation within three months to 4 weeks of the course commencement may incur a 20% charge of the total course fees. The International Rugby Academy of Australia reserves the right to decide where the customer is liable for the cancellation charge, determined by the circumstances of cancellation.
    • Cancellation within 4 weeks of the course will incur a 50% charge of the total course fees.
    • Cancellation within 2 weeks of the course will not be eligible for a refund and the full course fee will apply.
    • Where the participant seeks cancellation, the International Rugby Academy of Australia will advise if they have the option of transferral or deferment.
    • Where a participant has received deferment to a subsequent course, the date of the first deferment request will apply to any further requests for refunds, cancellation or deferment.
    • Requests for deferment made more than four weeks prior to the course will be provided free of charge.
    • Any deferment requests received within four weeks of the Course commencement date may still be liable for the cancellation fees as outlined above.

The International Rugby Academy of Australia will waive cancellation fees where special circumstances apply. The International Rugby Academy of Australia reserves the right to determine when these special circumstances apply.

6.    Liability and insurance

  • The International Rugby Academy of Australia shall not be liable to the customer in respect of any event of loss or damage of possessions, injury or expenses resulting from attendance at the course.
  • The customer is solely reliable for organising their own insurance at all times where it is deemed appropriate. The International Rugby Academy  of Australia will provide assistance where it is requested by the customer but will not be held responsible for participants without insurance.
